Chamber approves the end of the 10% FGTS fine for unfair dismissal.

The Plenary approved on Wednesday (3) the Complementary Bill 200/12 of the Senate, which extinguishes the social contribution of 10% on the entire balance of the Guarantee Fund for Length of Service (FGTS), due by employers in the event of unfair dismissal. The matter, approved by 315 votes to 95, will be sent for presidential sanction.

The argument of the proponents of the proposal is that the fine, created in 2001, has already fulfilled its purpose - the recomposition of FGTS accounts - and ended up becoming an extra tax. According to the proposal, the extinction will be retroactive to June 1, 2013.

The leader of the PSD, deputy Eduardo Sciarra (PR), said that for 13 months the government has been fattening its cash with the extra contribution. "We cannot allow this contribution to become an ad eternum tax," he said.

The government wanted to maintain the fine to secure resources for the Minha Casa, Minha Vida Program. Several allied base parties, however, voted in favor of the bill. The text will proceed to presidential sanction.
