Ordinance comes into force on May 1, 2023 - Bank bail and insurance

It was published in the Federal Official Gazette (DOU) by the Special Secretariat of the Federal Revenue to the RFB Ordinance No. 315 of 14-04-2023which provides for the form and conditions for the offering and the Acceptance of bank guarantee and insurance-garantia within the agency. “The garacy insurance and the bank bail provided, respectively, by an insurer or a suitable financial institution duly authorized to operate in the country, pursuant to the applicable regulatory legislation, aim to guarantee tax credits under the responsibility of the taxable person in the situations provided for in specific rules ”Defines the Ordinance, which will come into force on May 1, 2023.

The Ordinance, among its important points, brings criteria to be observed in the insurance policies and bank bail letters, general requirements for acceptance of documents, as well as requirements for the replacement of goods and rights and for Customs modality, including the characterization of the claim or settlement of the bail letter.
