The acting president, Michel Temer, enacted the Law of Responsibility of State-Owned Companies (Law 13,303 / 16), which establishes rules for the appointment of directors and administrative directors of public companies, mixed-capital companies and their subsidiaries. < / p>
The measure prohibits people with partisan performance in public positions from occupying management positions of state-owned companies. With this restriction, we try to avoid making political indications for the command of state-owned companies.
Another important change is the one that requires the quarantine of 36 months for party leaders and people who worked in electoral campaigns to assume the leadership. state employees.
To be appointed director of a public company, the server must have ten years of experience in companies in the sector or have worked for four years in similar institutions.
The changes apply to every public company and mixed-capital company of the Union, the States, the Federal District and municipalities with gross revenues above R $ 90 thousand.
The public company and the mixed-capital company established prior to the effectiveness of this Law must, within 24 (twenty-four) months, promote the necessary adaptations to adapt to the provisions of this Law.
